The Austrian Bar observes the current situation in Ukraine with horror and compassion. It strongly condemns Russia's attacks in violation of international law and reminds of the UN charta according to which all violence against sovereign and independent states is prohibited. In times like these, it is of utmost importance to show solidarity and support, especially for people who directly experience the terrible effects of the war.

The Austrian lawyers would therefore like to support you with what we do best, which is to assist persons in difficult life situations with competent legal advice and to represent their rights in the best possible way.

On March 4, 2022 the EU Council of Ministers confirmed, on the basis of Directive 2001/55/EC, the existence of a "mass influx" of displaced persons – i.e. people who have fled war and violence – from Ukraine and agreed to introduce temporary protection. This resolution was implemented in Austria by means of a regulation, so that Ukrainians and their family members as well as third-country nationals and stateless persons who were granted international protection in Ukraine, are granted a temporary residence permit for displaced persons after arrival in Austria, valid until March 3, 2023.

Furthermore, people fleeing Ukraine can apply for international protection. Whether this makes sense should be assessed individually in each case. Other third-country nationals fleeing Ukraine who are not covered by the IDP Regulation may also apply for international protection if they fear persecution (in relation to their country of origin).

In asylum and residence procedures, there is no requirement to be represented by a lawyer, but voluntary representation by a lawyer is of course possible.

Refugees from Ukraine who are in need, currently receive basic care in Austria. This includes accommodation, food and health insurance cover. Currently, refugees from Ukraine can use the Austrian Railway (ÖBB) and public transport in Vienna free of charge. Due to their residence permit, they also have free access to the labour market.
